Actually the BV 1.1 spec is already clear on that case:

validationAppliesTo (see Section 3.1.1.4, “validationAppliesTo”) is not necessary as cross-parameter constraints and return value constraints are declared in different XML elements, respectively cross-parameter and return-value.
