Marc, for the record Hardy convinced me when reviewing the pull request that the empty boolean query should be considered invalid: it will still throw an exception, but rather than an AssertException it's now a SearchException. We can review this as a follow up JIRA if you can make a good case for it to not be an invalid usage?
