We are using 4.2.12 and still see this behavior. It seems to contradict how the JSR specification describes the merge behavior to work.
Specifically under section:
3.2.4.1 Merging Detached Entity State
point 3
• If X is a removed entity instance, an IllegalArgumentException will be thrown by the
merge operation (or the transaction commit will fail).
