Well at least you are honest that this whole issue is silly

I'm inclined to leave this as is. setMaxResults(0) is meaningless enough to warrant any number of interpretations. And as this is how HIbernate has interpreted it for decades, I see no reason to change it without a decent reason (which you admit you cannot really give).
