~~HHH-8442~~ Is the issue that reverted the original fix. Scott claims it was for compliance with JPA from TCK runs. I've asked him to find where the spec says that this particular method should mark the transaction for rollback, as I could not find it.

Let's wait to hear back from him, as we obviously need to remain compliant with the spec.
