To be clear, I'm saying that the TCK is pre-requisite #1 for me ever giving a +1 to this.

As I have said above, throwing the exception was the original way I coded this and we failed some TCK test(s). So clearly I thought throwing the exception is the proper solution. If we get this challenged successfully then we definitely should get the spec clarified the next go-around, assuming there is another go-around.
