AFAIK there is no other explicit way how to exclude test in already released TCK version. Generally it is ok to exclude this also in 1.2.4.Final because it will be fixed in 1.2.6.Final (and it's on current exclude list).

Ok good to know however I still don't understand why the licensee couldn't file the issue directly by themselves. Thank's anyway.
