Leonardo,
I will not push existing and potential validation users in a wrong path. It would be very stupid and dishonest on my side. The catch is clear, some duplication definition if you do not use Hibernate as your JPA provider. 
When JPA 2 come, hibernate JPA user will alrady be in the right path, and non hibernate jpa users will just have to get rid of duplication.

If you don't want to use it, it's your choice. Just pick up what's more productive for you.
