It was not a requirement it was a choice between maintaining 2 source trees to use the correct jar embedded with AS, or add the jboss-backport-library into JBoss Portal so that the same source code can be used for Jboss AS 4.0.x and 4.2.x

I added jboss-backport-concurrent.jar in jboss portal distribution so now this part is fixed.
