I'm have a deadline so I probably won't get back to this until next week.  I'm using dynamic facts (beans with property change support) so that may have something to do with the bug.

By the way, my understanding is that Drools 4.0 changed modify() to update().  Even if it worked, that's not a solution in my case.  It's just as easy to reorder the actions as explained above.
