As an alternative to commenting out the jboss beans, you can rename persistence.xml to e.g. jpa-persistence.xml and explicitly configure org.springframework.orm.jpa.LocalContainerEntityManagerFactoryBean to use this file using setPersistenceXmlLocation. JBoss won't throw an exception then.
