Workaround which works for the particular code above ("most_recent_commission_income"):

Replace:
{code}
    not (exists (FYearlyIncome(ownedBy == $ownedBy, type == $type , year.index < $year.index, sustainable == $sustainable)))
{code}

by the following code snippet:

   not FYearlyIncome(ownedBy == $ownedBy, type == $type , year.index < $year.index, sustainable == $sustainable)
