I would have expected a deployment failure if you were using a MANDATORY tx attribute. Can you please post the relevant MDB code?
Keeping that aside, I wouldn't expect the MDB message listener method to join the same transaction that placed the data in the JMS destination. That's one of the reasons why I'm trying to understand how exactly you are ending up with this scenario. So a reproducible application/code would help.
