I think we found the solution to this problem. It is a combination of using the jbossall-client.jar from JBoss 3.2.8SP1, the VM argument 
-Dorg.jboss.j2ee.Serialization for the client and the installation of the old RetryInterceptor. Now the JDK 1.3 client can access JBoss 4 without problems. :-)
