There is a <ui:include> problem:
technically it is rendered correctly to the specified place. BUT <rich:dataTable> allows to render all facets elements (what is against JSF rules). 

It is possible to put all facet's children from <ui:include> while creating <rich:dataTable> template, but requires huge code changes: 
1) getting included file, reading its structure, finding facets, putting them inside datatable; 
2) after that -- disable or adjust <ui:include> creating. 

The best wayout would be if <rich:dataTable> behaves as h:dataTable, and do not render unneccessary facet elements.
