Okay, I think I have discovered the root of my problem. I split the modalpanels into seperate JSPs for readability. I then include the modalpanel using :
 <a4j:include a viewId="./insertRelatedEntity.jsp" />

These modalpanels contain suggestionboxes and rerenders. The default for ajaxRendered is true. Once set to false everything looks good. 

This must be new behavior since 3.2.0.......

ps - sorry about the nested forms....didn't even notice it. Your statement on ajaxRendered is what got me tinkering with the includes and stuff.
