I took the original test and tried it in 3.5.1, ripping out the Spring stuff, structuring
the test case as one of those found in the hibernate-entitymanager test suite.
However, both cases failed due to the Employee being inserted with an Email of: new
Email("Test","test.org") but the assertEquals was for
"James(a)test.org")
After correcting this, both queries returned the expected sequence, and seemed to produce
the same SQL.
The attached ZIP contains the files, for overlaying onto the hibernate-entitymanager
tree.

Using a userdefined @Type as parameter in a CriteriaQuery is not working properly.
The typeClass seems to be ignored.
Using the same @Type in a similar JPQL query is working as expected.
