Hi,
You should do as steps:
1 add a pick as the first element.
2 in the details tab of properties view, select the creatinstance checkbox
3 unselect createinstance checkbox in the details tab of properties view of the receive
element
It's ok.
BPEL validator does not recognize pick as start activity.

When the first activity of a process is pick instead of receive then the validator
falsely indicates that the process has no start activity. See attached image.
