If we want applications to be portable across different implementations
then the spec should require the least common multiple - that is beans
that belong to passivating scopes being serializable. TomEE/OWB is free
to have a mode in which passivation requirements are not checked if the
server runs in non-passivating mode.

tomee supports both and is aligned on tomcat for all tomee flavors and
is serialization-less in openejb flavors
