I also came along this error (lost of drag state) and think i can narrow down the symptom
a bit:
When dragging over a drop zone the dragIndicator is jerking (low performance on drag
validation?). This allows the cursor to hovering the dragIndicator when dragging to the
right or across down to the right. In this moment the drag aborts and dragIndicator
disappears. In some cases instead drag abort (a) the drop will be executed or (b) the
dragIndicator freezes for some seconds and then drag aborts.
If the cursor does not hover dragIndicator everything works fine. As this problem only
exists in IE8 a (tested) workaround is to enable compatibility mode (see
http://community.jboss.org/wiki/IE8CompatibilityModewithRichfaces)
I think this is a major problem (or at least with normal priority) cause DnD is not
usuable in IE8 (without enabled compatibility mode).
dragIndicator: low performance and drag state lost after overing the
drop zone under IE8.

drag any item and move it over drop zones without drop.
I'm able to see very low performance(in difference with FF3 and worse than in IE7)
and in some moment(vertical cursor movement over drop zone) item gets dropped without
mouse button releasing.
