I tried your example with success and sorry, I mixed things up a bit! The problem does not
occur in IE9&IE8 but it occurs in IE9 with compatibility mode. I misinterpreted the
icon in Internet Explorer. I guess RichFaces doesn't support the compatibility mode at
all.

Menu item of a drop down menu is not displayed if it overlaps a panel/tab panel header in
Internet Explorer 9. It works in Firefox and Internet Explorer in compatibility mode.
This issue might be related to RF-9097 of RichFaces 3.3.3.
