I've ported the test to ejb3 trunk; now in package ejbthree1053,
ConsistentPassivatedStateUnitTestCase. Added the test to the
src/test/resources/known-issues.xml file.

NestedBeanUnitTestCase.testConsistentPassivatedState() is a pretty weak test for the
EJBTHREE-1053 condition; when the parent issue is fixed, replace this test with something
