Apologies for the mistake.
We are on JBM 1.4 and not 1.3 as I mentioned in my original post.

However we do not have the Patch referred in this defect 
http://jira.jboss.org/jira/browse/JBMESSAGING-1112

Could it be that applying this patch will solve the problem?
