We don't include it in classpath when running tests. I've never encountered a problem with DefaultDS. If the bootstrap dir is on the classpath, embedded jboss should load the datasource out of its deploy directory. invokeApplication is executed as part of the JSF lifecycle. An exception during invokeApplication does not cause a request to abort. The exception is simply handled by Seam's normal error handling functionality.
