+of the Program, the Contributor who includes the Program in a commercial

+connection with its distribution of the Program in a commercial product

+relating to any actual or alleged intellectual property infringement. In order
+to qualify, an Indemnified Contributor must: a) promptly notify the Commercial
+Contributor in writing of such claim, and b) allow the Commercial Contributor

+any related settlement negotiations. The Indemnified Contributor may participate
+in any such claim at its own expense.

include the
+Program in a commercial product offering, Product X. That Contributor is then a
+Commercial Contributor. If that Commercial Contributor then makes performance
+claims, or offers warranties related to Product X, those performance claims and
+warranties are such Commercial Contributor's responsibility alone. Under this
+section, the Commercial Contributor would have to defend claims against the
+other Contributors related to those performance claims and warranties, and if a

+Commercial Contributor must pay those damages.

party\n\
+ Installable Software or a portion thereof to be accessed and copied to the
Target Machine.\n\
+ 3. Pursuant to the Specification, you will provide to the user the terms and
conditions that\n\
+ govern the use of the Installable Software ("Installable Software
Agreement") and such\n\
+ Installable Software Agreement shall be accessed from the Target Machine in
accordance\n\
+ with the Specification. Such Installable Software Agreement must inform the
user of the\n\
+ terms and conditions that govern the Installable Software and must solicit
acceptance by\n\
+ the end user in the manner prescribed in such Installable Software Agreement.
Upon such\n\
