In the meantime I also had a look at this... (well, Tom forced me to look at it to be honest ;-) ) I think that the criteria filter should appear as a block of controls at the bottom of the screen *if it is visible at all*. I would make it unvisible by default and provide a link that can toggle the visibility of this block, also at the bottom of the screen.
